Disputes between Avant members - conflicts of interest
Avant Law is a part of the Avant Mutual group of companies and operates independently as a commercial law firm. This means that we provide our legal services to clients across a number of sectors and industries, who may or may not be Avant members or holders of an Avant insurance policy).
From time to time, Avant Law is required to address and manage actual, potential or perceived conflicts of interests which may arise, including where Avant members or Avant insurance policy holders are in dispute with each other.
This may sometimes be a complex process and dependent on the unique circumstances of each matter. However, Avant Law will generally adopt the following approach to addressing and managing these particular types of conflicts of interest:
- 1. We will not act for a client to commence (or threaten to commence) legal action against an Avant member or practice holding an Avant medical indemnity policy, if defending or responding to that legal action is potentially covered under their Avant insurance policy.
- 2. If two or more Avant members, who are in dispute with each other, request that Avant Law acts as their legal representatives, we will ordinarily act for the Avant member who formally engages us first.
- 3. We will not act in a dispute against an existing client of Avant Law, unless that party consents to us doing so.
